U.S. Labor Department Seeking Back Wages for Restaurant Workers in Ohio

A restaurant in Ohio is facing a lawsuit by the U.S. Department of Labor in an attempt to recover back wages totaling roughly $21,390. An equal and separate amount is being sought in damages for a total amount of $42,780. The lawsuit is on behalf of 17 employees who worked at the restaurant.

According to the lawsuit, the Wage and Hour Division claims that the company violated FLSA regulations of overtime, minimum wage, and record keeping. As a result, the restaurant allegedly failed to pay workers for the entire amount of hours worked. The restaurant also allegedly failed to pay overtime wages when employees worked longer than the 40 hours.

The restaurant was also issued a penalty of $7,947 for their repeated FLSA violations. In a previous investigation, the restaurant was accused of withholding wages and were eventually forced to pay back a total of $33,813.
